These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding contract between you (“you,” “your,” “User,” or “Customer”) and Nexet Technology LLC governing your access to and use of our Website and the purchase of products offered through our online store.

BY ACCESSING, BROWSING, OR PLACING AN ORDER ON BARISCAPE.COM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. If you do not agree to these Terms, you must immediately cease using our Website and refrain from making any purchases.

3. PRODUCTS AND SERVICES

3.1 Product Descriptions

We specialize in premium home barista accessories and tools, including but not limited to portafilters, espresso baskets, distribution tools (WDT tools), milk pitchers, tampers, coffee cups, and related equipment. We make every effort to display accurate product descriptions, specifications, images, and pricing information on our Website.

However, we do not warrant that product descriptions, colors, images, or other content are completely accurate, error-free, current, or complete. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted an order).

Color Disclaimer: Product colors displayed on your screen may vary from actual product colors due to differences in monitor settings, screen resolution, lighting, and other factors. We are not responsible for such variations.

3.2 Product Availability and Quantity Limitations

All products are subject to availability. We reserve the right, in our sole discretion, to:

  • Refuse or cancel any order for any lawful reason

In the event a product is unavailable after an order has been placed, we will notify you promptly and issue a full refund or offer a suitable substitute, at your discretion.

Product dimensions, weights, capacities, and technical specifications are provided as accurately as possible. Minor variations may occur due to manufacturing tolerances and are not grounds for return unless they materially affect the functionality of the product.

4. PRICING AND PAYMENT TERMS

4.1 Currency

All prices displayed on Bariscape.com are listed in United States Dollars (USD) unless otherwise specified.

4.2 Pricing

Prices are subject to change at any time without prior notice. However, price changes will not affect orders that have already been confirmed and payment has been received. The price charged for a product will be the price displayed on the Website at the time you submit your order, subject to the terms of this Agreement.

4.3 Payment Methods and Processing

Payments are processed securely via  Stripe and PayPal. We accept major credit cards (Visa, Mastercard, American Express, Discover) and other payment methods as displayed at checkout.

By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method provided
  • All payment information is accurate, current, and complete
  • You will maintain sufficient funds or credit available to complete the transaction

4.4 Payment Authorization

When you place an order, you authorize us to charge the full amount of your purchase, including the product price, applicable sales tax, shipping fees, and any other charges, to your designated payment method. Authorization and/or charge may occur at the time you place your order or when the order ships, depending on the payment method used.

4.5 Sales Tax

Sales tax will be calculated and collected in accordance with applicable state and local tax laws based on the shipping destination address. As required by law, we collect sales tax in states where we have nexus or are otherwise obligated to collect such taxes. 4.6 Pricing Errors

Despite our best efforts, products on our Website may be listed at incorrect prices due to typographical errors, system malfunctions, or other mistakes. We reserve the right to refuse or cancel any order placed for a product listed at an incorrect price, even after an order confirmation has been sent.

If a product’s correct price is higher than the stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. If a product’s correct price is lower than the stated price, we will charge the lower amount and ship the product.

  • Pursue collection of any amounts owed, plus reasonable attorney’s fees and collection costs

5. SALES TAX COLLECTION

As required by applicable state and federal law, Nexet Technology LLC collects and remits sales tax on orders shipped to states where we have established sales tax nexus. Sales tax obligations are determined based on the destination address of your shipment.

5.2 Tax Exemptions

If you are a tax-exempt organization or qualify for a sales tax exemption, you must provide valid tax exemption documentation before placing your order. Please contact us at support@bariscape.com with your tax exemption certificate. Exemption certificates must be current and valid in the state of delivery.

We cannot issue refunds for sales tax after an order has been completed if you did not provide exemption documentation in advance.

6. SHIPPING AND DELIVERY

6.1 Shipping Locations

We ship to addresses within the United States and select international locations. Shipping options, carriers, costs, and estimated delivery times will be displayed at checkout and vary based on your location and the shipping method selected.

6.2 Estimated Delivery Times

Estimated delivery times are approximations only and are not guaranteed. Actual delivery times may vary due to factors beyond our control, including but not limited to:

  • Carrier delays or service disruptions
  • Weather conditions or natural disasters
  • Customs clearance (for international shipments)
  • Incorrect or incomplete shipping addresses
  • Public holidays
  • Force majeure events

We are not responsible for delays caused by third-party shipping carriers.

6.3 Shipping Costs

Shipping costs are calculated based on the weight, dimensions, and destination of your order and will be displayed at checkout before you complete your purchase. Shipping charges are non-refundable except where products are defective or an error was made on our part.

6.4 Order Processing

6.5 Risk of Loss and Title Transfer (FOB Shipping Point)

IMPORTANT: IN ACCORDANCE WITH STANDARD U.S. COMMERCIAL PRACTICES, THE RISK OF LOSS AND TITLE FOR ALL PRODUCTS PURCHASED FROM BARISCAPE.COM PASS TO YOU UPON DELIVERY OF THE PRODUCTS TO THE CARRIER (FOB SHIPPING POINT).

This means that once we deliver your package to the shipping carrier (e.g., USPS, UPS, FedEx), you assume all risk of loss, damage, delay, or theft during transit. Nexet Technology LLC is not liable for lost, stolen, damaged, or delayed shipments once they have been delivered to the carrier.

We strongly recommend that you:

  • Purchase shipping insurance or additional carrier protection if available
  • Track your shipment and ensure someone is available to receive it
  • Inspect packages immediately upon delivery for visible damage

6.6 Damaged or Lost Shipments

If your package is lost, stolen, or damaged in transit:

  • For insured shipments: Contact the carrier immediately to file a claim
  • For uninsured shipments: We will make reasonable efforts to assist you in filing a claim with the carrier, but we cannot guarantee reimbursement

We are not responsible for replacing or refunding products lost or damaged after delivery to the carrier unless shipping insurance was purchased and the claim is approved.

6.7 Incorrect Shipping Addresses

You are responsible for providing accurate and complete shipping information. We are not responsible for orders shipped to incorrect addresses provided by you. If a package is returned to us due to an incorrect address, you will be responsible for the cost of reshipping.

6.8 International Shipments

For international orders, you (the customer) are responsible for:

  • All customs duties, import taxes, VAT, tariffs, and other fees imposed by your country
  • Compliance with all import regulations and restrictions in your country
  • Any delays caused by customs clearance

Refusal to pay customs duties or accept delivery does not entitle you to a refund.

7. RETURNS, REFUNDS, AND EXCHANGES

7.1 30-Day Return Policy

We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible products within 30 days of the delivery date for a refund or exchange, subject to the conditions outlined in this section.

7.2 Return Eligibility

To be eligible for a return, products must meet the following criteria:

  • Unused, unworn, and in the same condition as received
  • In original packaging with all tags, labels, manuals, and accessories intact
  • Accompanied by proof of purchase (order number or receipt)

7.3 HYGIENE AND HEALTH SAFETY RETURN RESTRICTIONS

IMPORTANT NOTICE: For health, safety, and hygiene reasons, certain products cannot be returned once they have been opened, unpacked, used, or if the protective seal or packaging has been broken.

Non-returnable items include, but are not limited to:

  • Espresso portafilter baskets that have been unpacked, used with coffee grounds, or removed from protective packaging
  • Milk pitchers, frothing jugs, or steamers that have been used with milk, beverages, or liquids
  • Coffee cups, mugs, glassware, or drinkware that have been used or washed
  • WDT (Weiss Distribution Technique) tools, distribution tools, or stirrers that have been used with coffee
  • Tampers or leveling tools that have been used with coffee grounds
  • Filters, screens, or any coffee contact surfaces that have been used or exposed to coffee, water, or cleaning agents
  • Any product showing signs of use, wear, staining, or contamination

Exception for Defective Products: Hygiene-sensitive items may be returned regardless of use or opened packaging if the product is:

  • Defective or damaged upon arrival
  • Materially different from the product description on our Website
  • Not functioning as intended due to a manufacturing defect

In such cases, please contact us within 7 days of delivery with photographic evidence of the defect or damage. We will arrange for a return, replacement, or full refund at no cost to you, including return shipping.

7.4 Non-Returnable Items (General)

In addition to hygiene-sensitive items, the following are not eligible for return:

  • Customized, personalized, or made-to-order products
  • Clearance or final sale items (marked as such on the Website)
  • Gift cards or store credit
  • Downloadable digital products (if applicable)

7.5 Return Process

To initiate a return:

  1. Contact us at support@bariscape.com within 30 days of delivery with your order number and reason for return
  2. Wait for return authorization and instructions (do not return items without authorization)
  3. Carefully package the item in its original packaging to prevent damage during return shipping
  4. Ship the item using a trackable shipping method (we recommend insurance for high-value items)

You are responsible for return shipping costs unless the return is due to our error (wrong item shipped, defective product, etc.).

7.6 Refunds

Once we receive and inspect your returned item, we will notify you of the approval or rejection of your refund.

Approved refunds will be processed as follows:

  • Refund amount: Original purchase price minus original shipping costs (unless the return is due to our error)
  • Refund method: Issued to the original payment method used for the purchase
  • Processing time: 5-10 business days after approval (actual credit may take additional time depending on your financial institution)

Shipping costs are non-refundable unless the return is due to our error or a defective product.

7.7 Exchanges

We do not offer direct exchanges. If you wish to exchange a product for a different size, color, or model, please return the original item for a refund and place a new order for the desired product.

7.8 Damaged or Defective Products

If you receive a damaged or defective product, please contact us within 7 days of delivery with:

  • Description of the damage or defect
  • Clear photographs showing the issue

We will provide a prepaid return label and issue a full refund or replacement at no cost to you.

7.9 Restocking Fees

We do not charge restocking fees unless the product is returned in a condition that is not resellable due to customer damage, missing components, or lack of original packaging (excluding hygiene-sensitive items, which are non-returnable if opened).

Products sold on Bariscape.com may be covered by manufacturer warranties. Warranty terms, duration, and coverage vary by product and manufacturer. 8.2 DISCLAIMER OF WARRANTIES

  • ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE

WE DO NOT WARRANT THAT:

  • THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • DEFECTS WILL BE CORRECTED
  • THE WEBSITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • PRODUCTS WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS

Some states do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, implied warranties are limited to the shortest duration permitted by law.

9. LIMITATION OF LIABILITY

9.1 EXCLUSION OF DAMAGES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXET TECHNOLOGY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, OR BUSINESS
  • LOSS OF DATA OR INFORMATION
  • BUSINESS INTERRUPTION
  • LOSS OF GOODWILL OR REPUTATION
  • COST OF SUBSTITUTE PRODUCTS OR SERVICES

THIS LIMITATION APPLIES WHETHER SUCH DAMAGES ARISE FROM:

  • BREACH OF CONTRACT
  • BREACH OF WARRANTY
  • NEGLIGENCE
  • STRICT LIABILITY
  • TORT
  • OR ANY OTHER LEGAL THEORY

THIS LIMITATION APPLIES EVEN IF NEXET TECHNOLOGY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 CAP ON LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO NEXET TECHNOLOGY LLC FOR PRODUCTS PURCHASED DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

9.3 State-Specific Limitations

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9.4 Essential Purpose

You acknowledge and agree that the limitations of liability set forth in this section are fundamental elements of the agreement between you and Nexet Technology LLC, and that we would not be able to provide products and services at our current pricing without these limitations.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nexet Technology LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, arising from or relating to:

  • Your use or misuse of the Website or products
  • Your breach of these Terms
  • Your violation of any law, regulation, or third-party rights
  • Any content you submit or transmit through the Website
  • Any negligent or wrongful conduct by you

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

The Bariscape name, logo, and all related product and service names, designs, and slogans are trademarks of Nexet Technology LLC. You may not use these marks without our prior written permission.

11.2 License to Use Website

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Website for personal, non-commercial purposes. This license does not include any right to:

  • Resell or make commercial use of the Website or Content
  • Collect or use product listings, descriptions, or prices for the benefit of another merchant
  • Make derivative uses of the Website or Content

We do not regularly monitor User Content, but we reserve the right to do so. We are not responsible for the accuracy, appropriateness, or legality of User Content submitted by users.

12.5 Product Reviews

We will attempt to resolve the dispute in good faith within 30 days. If we are unable to reach a resolution, either party may proceed with formal dispute resolution as outlined below.

13.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or the purchase of products (collectively, “Disputes”) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules.

Arbitration Location: All arbitration proceedings shall take place in Sheridan County, Wyoming, unless otherwise mutually agreed by the parties.

Arbitrator Authority: The arbitrator shall have exclusive authority to resolve all Disputes, including but not limited to disputes regarding the interpretation, applicability, enforceability, or formation of these Terms, including the arbitrability of any claim and the scope of this arbitration agreement.

Arbitration Costs: Each party shall bear its own costs of arbitration, including attorney’s fees, unless otherwise awarded by the arbitrator in accordance with applicable law.

Judgment: The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

13.3 Class Action Waiver

YOU AND NEXET TECHNOLOGY LLC AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both you and Nexet Technology LLC agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

13.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies and remains in small claims court.

Additionally, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

13.5 Opt-Out Right

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to the following address within 30 days of your first use of the Website or acceptance of these Terms:

Your notice must include your name, address, email address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, all other terms of this Agreement will continue to apply, but Disputes will be resolved in accordance with Section 2.2 (Jurisdiction).

13.6 Severability
